RESPONSIBLE FOR THE PERSONAL DATA.
Sparkassenstiftung für internationale Kooperation, E.V. (onwards DSIK) with fiscal adress in José Enrique Pestalozzi 810, Colonia Narvarte Poniente, Alcaldía Benito Juárez, Ciudad de México, Zip Code 03020 is convinced to protect the personal information provided by the participants (hereinafter “Personal Data”) who register in the calls for Silver Finance initiatives (hereinafter the “Participants”) and is responsible for its Treatment (term defined more hereinafter) when they are collected through the Internet sites and/or platforms provided for the calls for Silver Finance initiatives (hereinafter the “Site”) or by any other means, present or future, used by Sparkassenstiftung für internationale Kooperation.
PURPOSE OF THE PROCESSING OF PERSONAL DATA.
Sparkassenstiftung für internationale Kooperation may request and/or collect through the Site, the Personal Data of the Participants for the purposes indicated below, as well as to comply with legal provisions that require it (hereinafter “Treatment”). Sparkassenstiftung für internationale Kooperation and/or any third party involved in any phase of the Processing of Personal Data shall keep such data confidential in accordance with the legal provisions applicable in the United Mexican States (hereinafter "Mexico").
The Personal Data provided by the Participants through the Site are intended i) to advise the Participants on Silver Finance initiatives; ii) identification of the user as the primary means of contact for informative follow-up, to monitor user activity as part of the Silver Finance initiatives, to send simple notifications and for the implementation of personalized dissemination tools based on the user’s profile; iii) to verify compliance with the rules of the call, for audience segmentation, to personalize informative content, to create a monitoring profile and optimize the delivery of resources to the Participants in the Silver Finance initiatives; iv) to classify strategic needs of the entrepreneurship and conduct training, support and linkage actions with other entities linked to the of the Silver Finance initiatives; v) to review compliance with agreements with financial institutions, to decide on business development activities and the development of collaborative projects; and vi) comply with obligations contracted with our clients and, in particular, with the company Sparkassenstiftung Für Internationale Kooperation E.V.
PERSONAL DATA TO BE COLLECTED.
For the before mention purposes, we may collect your personal data in different ways. We usually collect your data when you provide it to us directly, either to our partners or through the Site. Sometimes, we obtain your data indirectly, through other sources that are permitted by law.
The data we obtain from Participants may be, among others, the following:
- Full name
- Date of birth
- Location
- Home Address
- Nacionality
- Company to which it belongs
- Biography
- General commercial and/or financial information of your company
- Gender
- Occupation
- Telephone
PRIVACY AND CONSENT.
In the case of participants over 18 years old, the sending of their data through the Site implies the full and unreserved consent of the Participants for the Treatment of their Personal Data in accordance with this Privacy Notice.
The owner of the Personal Data states to be over 18 years old on the date on which they are provided and has full legal capacity. When the data of minors or people who are in a state of interdiction or incapacity established by law are processed, Personal Data of said owners will not be collected, without the prior consent of the person who exercises parental authority, or in If applicable, of the guardian or legal representative, in accordance with the rules of representation applicable in each case and in accordance with the following section.
MEANS TO LIMIT THE USE OR DISCLOSURE OF PERSONAL DATA.
To guarantee the protection of your personal data and to limit the unauthorized use or disclosure thereof, Sparkassenstiftung für internationale Kooperation will maintain the confidentiality of said information, managing the databases that contain it by the persons designated by Sparkassenstiftung für internationale Kooperation to such effect, without allowing its use, consultation, management, or access to unauthorized persons.
EXCLUSION OF SITE LIABILITY.
When browsing or using the Site, the User may encounter hyperlinks or hypertexts, banners, buttons and/or search tools on the World Wide Web that, when used by the Participants, lead to other portals or Internet sites that may be owned by third parties. Personal Data that Participants may provide through these portals or websites are not covered by this Privacy Notice and Sparkassenstiftung für internationale Kooperation is not responsible for their processing. We recommend that Participants check the Privacy Notices displayed and applicable to these portals and websites.
Participants may find pages and other services within the Site that may be shared with third parties that may request their Personal Data (hereinafter “Third Party Sites”). Any information related to Personal Data provided through Third Party Sites will be subject to the respective privacy notices contained on each Third-Party Site, unless otherwise indicated by Sparkassenstiftung für internationale Kooperation.
Sparkassenstiftung für internationale Kooperation advises its Participants that Personal Data disclosed through such means may in some cases be accessible by third parties. Sparkassenstiftung für internationale Kooperation shall not be liable for the use, publication, disclosure and/or dissemination of Personal Data used, published, disclosed and/or disseminated through the before mention means. We advise Participants to be careful and responsible about any personal information they provide in such media.
TRANSFER OF PERSONAL DATA.
Sparkassenstiftung für internationale Kooperation may, without the consent of the owner, disclose, divulge and/or transfer within and outside the country the Personal Data provided by the Participants, to: i) its affiliates, subsidiaries and/or related companies; ii) the company Sparkassenstiftung Für Internationale Kooperation E.V., contracting party of the Silver Finance initiatives, its employees and collaborators in Mexico and abroad; iii) third party service providers of Silver Finance for compliance with legal, accounting and regulatory obligations of Sparkassenstiftung für internationale Kooperation; iv) third parties for marketing, information technology, operation, administration, commercialization, business development and other similar and lawful purposes; as well as to comply with legal provisions that so require, or when requested by competent authorities.
If you do not express your opposition to the transfer of your personal data, it will be understood that you have given your consent to do so. Otherwise, you consent to the transfer of your personal data under the terms set forth in this privacy notice.
MEANS TO EXERCISE THE RIGHTS OF THE HOLDERS OF PERSONAL DATA AND REVOCATION OF CONSENT.
Participants may request the exercise of their rights to:
- Access their Personal Data;
- Rectify their Personal Data when it is inaccurate or incomplete;
- Cancel their Personal Data;
- Oppose for legitimate reasons the Processing of their Personal Data; and/or
- Revoke your consent to the Processing of your Personal Data at any time, in order to stop the use of your Personal Data.
However, it is important to note that not in all cases we will be able to respond to your request to cancel your Personal Data, oppose the Processing or revoke your consent, since it is possible that due to a legal obligation, we may be required to continue processing your Personal Data.
The exercise of the rights of Access, Rectification, Cancellation or Opposition of Personal Data and Revocation of Consent by Participants must be requested to Sparkassenstiftung für internationale Kooperation and contain at least the following:
- The name of the holder, address and e-mail to communicate the response to your request;
- The documents proving the identity or, as the case may be, the legal representation of the holder;
- The clear and precise description of the Personal Data with respect to which the holder seeks to exercise any of the aforementioned rights (in the case of rectification, the modifications to be made must be indicated and the documentation supporting the request must be provided); Any other element or document that facilitates the location of the Personal Data.
For this purpose, Sparkassenstiftung für internationale Kooperation provides users with the following e-mail address as the sole means of communication: contacto@sparkassenstiftung.de.
Sparkassenstiftung für internationale Kooperation will respond to the Participant’s request within 20 working days from the date on which it receives the corresponding request, via the e-mail address provided for such purpose.
The exercise by the Participants of the before mentioned rights shall be subject to the applicable laws and regulations in force in Mexico.
COOKIES AND WEB BEACONS.
To enhance the Participants’ experience on the Site, Sparkassenstiftung für internationale Kooperation may use “cookies”. For purposes of this Privacy Notice “cookies” shall be identified as text files of information that a website transfers to the hard drive of a Participant’s computer for the purpose of storing certain records and preferences. Sparkassenstiftung für internationale Kooperation may use “cookies” to better understand Participants’ interaction with the Site and the services provided. The Site may allow advertising or third-party functions to send cookies to Participants’ computers. The use of cookies does not personally identify Participants, only their computers.
Web beacons are images inserted in an Internet page or e-mail that can be used to monitor the behavior of a visitor, such as storing information about the user’s IP address, browsing time, duration of interaction time on the Site, sections consulted, Internet pages accessed prior to ours and the type of browser used.
Participants may change their options through their computers and/or browsers to stop accepting cookies and/or web beacons or confirm whether or not to accept them.
SENSITIVE PERSONAL DATA.
In accordance with the Mexican legislation in force, “Sensitive Personal Data” are those personal data that affect the most intimate sphere of their owner, or whose improper use may give rise to discrimination or entail a serious risk for the owner. In particular, sensitive data are considered those that may reveal aspects such as racial or ethnic origin, present and future health status, genetic information, religious, philosophical and moral beliefs, union membership, political opinions, sexual preference.
In addition, Sparkassenstiftung für internationale Kooperation may collect financial and property data that is necessary for the legal obligations arising from the nature of the relationship with Sparkassenstiftung für internationale Kooperation and the Silver Finance initiatives. This includes, but is not limited to, the type and number of your company’s bank account and the bank, among other things.
In case Sparkassenstiftung für internationale Kooperation require Sensitive Personal Data from the Participants, the Participants must provide their express consent.
CHANGES TO THE PRIVACY NOTICE.
Sparkassenstiftung für internationale Kooperation reserves the right to change the content of this Privacy Notice at any time. Any changes to the Privacy Notice will be communicated to its Participants through the Site.
Once the Privacy Notice is published it will automatically become effective.
The effective date of this notice is December 05, 2023.
